Limitation on When a Lawsuit May Begin
You may not start a lawsuit to obtain benefits until after
you have requested a review and a final decision has been
reached on review, or until the appropriate time frame
has elapsed since you filed a request for review and you
have not received a final decision or notice that an extension
will be necessary to reach a final decision. The law also permits you to pursue your remedies under
Section 502(a) of the Employee Retirement Income
Security Act without exhausting these appeal procedures
if the Plan has failed to follow them. No lawsuit may be
started more than three years after the end of the year in
which services were provided.
